2A. Website Use and App Registration

Our website is provided as an informational and promotional pass-through to help you find and download Bond by Voice on the Apple App Store or Google Play Store. The website does not collect your email address or other personal information.

When you register for an account in the Bond by Voice app, you provide an email address, which we may use to send account-related and service updates, and promotional and marketing emails. You may unsubscribe from promotional and marketing emails at any time; account-related and service updates necessary to operate the Service may not be optional.

Registering an account does not guarantee specific promotions or offers. We are not liable for damages, data loss, or issues from website use.

4. Subscription, Free Trial, and Cancellation

Free Trial
‍New users receive a 3-day free trial, which includes one voice profile, access to available stories, lullabies,and songs in the app, and the ability to create personalized stories using your recorded voice, subject to the usage allowance described below. The trial automatically converts to a paid subscription unless canceled at least 24 hours before the trial ends.

Subscription Tiers and Usage Allowances
‍Bond by Voice offers multiple subscription tiers. Each tier includes a different monthly allowance of personalized story conversions and a different number of included voice profiles. Current tier names,conversion allowances, included voice profiles, and pricing are presented to you at the time of purchase in the Apple App Store or Google Play Store, and may be updated, renamed, or restructured by App Merchant, Inc. from time to time. Any such changes will apply prospectively and will be reflected in the purchase screen and/or in-app account details before you are charged at a new rate.

‍Voice Profile Add-Ons
You may purchase additional voice profiles beyond those included in your subscription tier, at the price displayed in the app at the time of purchase. Voice profile add-on purchases are one-time purchases tied to your account and are not refundable except as required by Apple App Store or Google Play Store policy.

Cancellation
Cancel via Apple: Settings → Subscriptions, or Google Play: Play Store → Subscriptions. Deleting the app does NOT cancel.

What happens to your content after cancellation.
Content you have already generated — including personalized stories, songs, and other output created using your voice profile — remains accessible for playback even if your subscription lapses or is canceled. Generating new personalized content, creating new voice profiles, and using the Professional Voice Cloning add-on all require an active subscription.Your voice profile and any underlying voice model remain subject to the retention and deletion schedule described in our Privacy Policy, regardless of subscription status.

‍Lifetime or Fixed-Term Access
‍If Bond by Voice offers any subscription, membership, promotional access, fixed-term access, one-time purchase, or “lifetime” access option, such access is provided only for as long as the Bond by Voice Service remains commercially available and supported by App Merchant, Inc. “Lifetime” refers solely to the operational lifetime of the Bond by Voice Service and does not refer to the lifetime of any user, account,device, operating system, or individual.

Access may end, and certain features may cease functioning, if the Service is discontinued, retired,removed from distribution platforms, no longer supported, or if required third-party services become unavailable. App Merchant, Inc. reserves the right to modify, suspend, discontinue, or retire the Service at any time. No subscription, membership, fixed-term access, promotional access, or lifetime access shall be construed as a guarantee of perpetual availability.

In such cases, continued access, updates, support, content availability, or functionality are not guaranteed beyond the date the Service is discontinued or no longer supported.

You own your content. We have rights to use it to operate the service

Data is stored using reputable, industry-leading cloud infrastructure providers, including Amazon WebServices (AWS). We are not liable for third-party breaches. See our Privacy Policy for details on our named data processors.

7. Personal Data Usage

We use your data to operate the app, improve services, and communicate updates. See our Privacy Policy for full detail.

8. AI and Voice Cloning

By submitting, uploading, recording, or otherwise providing any voice, audio, speech, or related content to Bond by Voice, you represent and warrant that:

You are the owner of the voice being submitted, or you have obtained all necessary permissions, authorizations, and legally valid consent from the voice owner.
You have the legal right to provide such voice, audio, speech, or related content to Bond by Voice and its service providers for processing.
You have obtained all rights and consents necessary for Bond by Voice, its affiliates, contractors,technology providers, cloud providers, and artificial intelligence partners to process, analyze, reproduce, model, clone, synthesize, modify, store, and generate content using the submitted voice data.
Your use of the Service does not violate the privacy, publicity, intellectual property, contractual, or other legal rights of any person or entity.

Voices of minors. Bond by Voice is designed so that adult voices are heard by children — not for creating synthetic voices of children. You may not submit, upload, or record the voice of any person under 18 years of age, and you represent and warrant that no voice you submit belongs to a person under 18. This prohibition applies even if you are the minor’s parent or legal guardian, and regardless of any consent you may hold or provide.If we become aware, or reasonably believe, that a voice submitted to the Service belongs to a person under 18, we may remove the associated recording and any derived voice model without prior notice, and may suspend or terminate the account under Section 10.

Voice of a deceased person. If you submit voice, audio, speech, or related content of a person who is deceased, you additionally represent and warrant that you are the deceased person’s legal heir, personal representative, or estate executor, or that you otherwise hold the legal right under applicable law to authorize the use of that person’s voice, and that such use does not violate any right of publicity, right of privacy, or other applicable law of the jurisdiction governing the deceased person’s estate. You are solely responsible for confirming you hold this right before submitting such content.

Voice of a person unable to provide consent. If you submit voice, audio, speech, or related content of a person who is living but unable to provide consent directly due to incapacity, you additionally represent and warrant that you hold valid legal authority to act on that person’s behalf — such as a valid power of attorney, legal guardianship, or conservatorship — sufficient under applicable law to authorize the use of that person’s voice for the purposes described in this Section 8, that such use is within the scope of that legal authority, and that it does not violate any right of that person. You are solely responsible for confirming you hold this authority before submitting such content, and for producing evidence of it if requested by App Merchant, Inc. or required by law.You acknowledge and agree that you are solely responsible for obtaining any required permissions and consents before submitting voice data to the Service. Bond by Voice may rely on your representations regarding ownership and consent and is not responsible for independently verifying your authority to submit any voice or audio content.

Confirmation at the point of recording. Before you record or upload a voice, you will be asked to affirmatively check a box confirming: “I confirm this is an adult’s voice — mine, or one I have legal authorization to submit, as described in our Terms of Use.” This confirmation is required separately for each voice you submit and does not replace or limit the representations and warranties in this Section 8;checking the box reconfirms, and is evidence of, those representations and warranties as they apply to that specific voice submission.Voice cloning and generated voice content are intended for entertainment and personal use only. Results may vary, and Bond by Voice does not guarantee that generated content will perfectly replicate any natural voice.Results may vary. Service is for entertainment only.

8A. Professional Voice Cloning (PVC) Add-On

Bond by Voice offers an optional, separately purchased Professional Voice Cloning (“PVC”) add-on intended to produce a more refined and natural-sounding voice than the standard voice feature included with your subscription.

Sample requirements. PVC requires a minimum of approximately 30 minutes of clear voice audio, with approximately 3 hours recommended for best results. You may build your voice sample by recording directly within the app across one or more sessions, by uploading existing MP3 audio files, or by combining both methods. The app displays your combined total recording time as you go, and the submission option activates once you reach the minimum threshold. You are solely responsible for ensuring your submitted audio meets quality requirements, and the same ownership and consent warranties in Section 8 apply in full to any audio you record or upload for PVC.

Processing time. After you submit your recording and complete a brief voice verification step, your Professional Voice Clone is typically ready within 2–6 hours, though actual processing time may vary and is not guaranteed.

Fees and refunds. The PVC add-on fee covers the cloning service and processing of your submitted sample, not a guaranteed outcome. Because PVC requires substantial processing resources, the add-on fee is non-refundable once processing has begun, except where required by Apple App Store or Google Play Store policy or applicable law. If your subscription is canceled or expires while PVC processing is underway, processing will continue and the completed voice model will be made available to your account;however, generating new content with that voice model still requires an active subscription. See Section 4for what happens to content you’ve already generated.

No guarantee of outcome. As with the standard voice feature, Bond by Voice does not guarantee that a PVC voice model will perfectly replicate any natural voice, and variation in results is expected and is not considered a defect.

Results may vary. Service is for entertainment only.

9. Voice Modeling Disclaimer

Generated voices may not perfectly match real voice. This is not considered a defect.

  10. Termination

We may terminate access if these Terms are violated.

11. Limitation of Liability

We are not liable for indirect or consequential damages.

12. Disclaimer of Warranties

Service is provided “as is.” No guarantees of outcomes.

13. Indemnification

You agree to indemnify, defend, and hold harmless App Merchant, Inc. and its officers, employees,contractors, and technology partners from and against any claims, damages, losses, and expenses(including reasonable attorneys’ fees) arising out of or related to: (a) your breach of these Terms; (b) your violation of any law or the rights of a third party; or (c) any voice, audio, speech, or other content you submit, including any claim that you lacked the necessary rights or consent to submit it.

14. Dispute Resolution; Arbitration Agreement; Class Action Waiver

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit incourt.

Agreement to arbitrate. You and App Merchant, Inc. agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Privacy Policy, or your use of Bond by Voice will be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, rather than in court, except as set out below. This agreement to arbitrate is governed by the Federal Arbitration Act.

Class action waiver. You and App Merchant, Inc. agree that any arbitration or proceeding will be conducted only on an individual basis and not as a class, collective, consolidated, or representative action.Neither you nor App Merchant, Inc. may bring a claim on behalf of other users, and the arbitrator may not combine more than one person’s claims into a single proceeding without the consent of all parties.

Exceptions. Either party may bring an individual claim in small claims court instead of arbitration. Either party may also seek injunctive or other equitable relief in court for actual or threatened infringement,misappropriation, or violation of intellectual property rights. Nothing in this section limits a right that cannot be waived under applicable law, including, to the extent required under California law, a right to seek public injunctive relief in a judicial forum.

Right to opt out. You may opt out of this arbitration agreement and class action waiver by emailingcontact@bondbyvoice.com with the subject line “Arbitration Opt-Out” within 30 days of the date you first agree to these Terms, including your name and the email address associated with your account. If you opt out, disputes will be resolved in the courts identified in Section 18, and all other provisions of these Terms remain in effect.

Arbitration procedure. Arbitration will be conducted by a single arbitrator. Unless you and App Merchant,Inc. agree otherwise, the arbitration will be conducted in the county where App Merchant, Inc. maintains its principal place of business, or remotely by videoconference where permitted by AAA rules. The arbitrator’s decision will be final and binding, subject to limited judicial review under the Federal Arbitration Act.

Severability. If the class action waiver in this section is found unenforceable as to a particular claim or request for relief, that claim or request must proceed in court, severed from any arbitration, and the remainder of this arbitration agreement will still apply.

15. Parental Responsibility

Parents are responsible for screen time and safe usage.

16. DMCA Notice and Takedown

We respect the intellectual property rights of others and expect users of the Service to do the same. If you believe content available through Bond by Voice infringes your copyright, you may send a notice under the Digital Millennium Copyright Act (“DMCA”) to our designated agent at contact@bondbyvoice.com, including:

A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
Identification of the copyrighted work claimed to have been infringed
Identification of the material claimed to be infringing and information reasonably sufficient to locate it within the Service
Your contact information, including address, telephone number, and email address
A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf

If you believe material you posted was removed in error, you may submit a counter-notice to the same address containing the information required under 17 U.S.C. § 512(g)(3). We may terminate the accounts of users determined to be repeat infringers.

App Merchant, Inc. intends to register a designated DMCA agent with the U.S. Copyright Office prior to launch;the contact address above will be updated to match that registration if different.

17. Changes to Terms

We may update these Terms at any time. You are responsible for reviewing updates. Continued use means acceptance. If we make a material change to Section 14 (Dispute Resolution; Arbitration Agreement; Class Action Waiver), we will provide notice and, where required by law, a renewed opportunity to opt out.

18. Governing Law

Florida law applies, except that the Federal Arbitration Act governs Section 14. Subject to Section 14, you and App Merchant, Inc. agree that any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Florida.
